Introduction

This website, www.winery2u.com and its sister domain and redirect www.winery2u.com.au, is a marketing agent operated on behalf of all partner wineries listed on the site. We are a family operated business. Anybody who uses the site accepts and agrees to be bound by the following terms and conditions. We may change these website terms at any time without notice. Please review these website terms regularly to ensure you are aware of any changes made.

Buying wine

It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Anybody who purchases wine from any of the wineries represented on winery2u.com, via winery2u.com, undertakes that they are over the age of 18 years. They also undertake that any person they are obtaining products for, or supplying products to, is/are over the age of 18 years.

Any purchase made via winery2u.com is an agreement between you, the purchaser, and the individual winery. All wineries who deal with winery2u.com agree to a memorandum of understanding which complies with the standards of these terms and conditons. winery2u.com represents you, the purchaser, for the duration of the purchase to ensure wine is delivered in a timely and reasonable manner.

When you make a purchase via the winery2u.com site, we offer the use of secure server software (secure sockets layer – SSL). Server-Gated Cryptography (SGC) Certificates enable 128- or 256-bit SSL encryption (depending on the Web browser, operating system, and host server), the most powerful SSL encryption commercially available today.

We do not store – nor do we see – any credit card information unless it is provided to us via email or telephone. Rather, we utilise the secure services of eWay and BankWest for the purposes of processing. Your address details and payment are then passes onto the wineries in order for them to process your order.

In the event that payment has been made to winery2u.com by credit card, you agree that you will not seek to charge back your payment to winery2u.com. If for some reason wine you ordered is not available, you will be issued with a gift voucher for the value of your original purchase.

It is the responsibility of the winery to include a tax invoice with the delivery.

Quality

winery2u.com is not responsible for wine quality, packaging or bottling of wine as these matters are the responsibility of the winery. winery2u.com represents the wineries, and also represents you the buyer, to ensure to the best of our ability, the smooth transaction of wine. However, by using the winery2u.com service, you agree not to hold winery2u.com liable for any issues which arise from quality of wine, packaging, bottling, or handling of wine.

When partnering winery2u.com, all wineries agree that they will ensure wine reaches customers in good consumable order. They agree to replace breakages or product which is deemed inconsumable.

Delivery

Wineries who partner winery2u.com agree to despatch within 7 days of order. Most will despatch within 48 hours, and many sooner. This is the responsibility of the winery. winery2u.com undertakes to facilitate the sale within 24 hours of order. The time it takes to delivery the wine will depend on your delivery address and the location of the winery from which you order.

The choice of delivery courier is that of the winery. Most wineries who partner winery2u.com prefer Australia Post or Fastway, depending on the area they are in. In the case of Australia Post deliveries, we will provide you wtih a tracking number so you can track your order at any time. At the time of ordering, please take time to specify what you would like done with your order in the case you are not home.

All wineries undertake to inform winery2u.com of changes to stock within 48 hours. That is, if they are out of stock, they will inform us within 48 hours so we can update our inventory of wines.

If, in the circumstance the item you order is out of stock, winery2u.com will issue a gift voucher for the amount of the wine so you can order an alternative wine.

winery2u.com will undertake its best endeavours to facilitate a suitable outcome if your order cannot be fulfilled. The supplier agrees that all products will not be spoilt at the time of delivery. Any product which has perished, or is not consumable as reasonably expected by the consumer will be replaced by the supplier. The supplier also agrees to replace bottles which have been broken or spoilt in transit.

You can order as many wines as you like from the winery2u.com shop, however please note that as your wine is coming directly from the wineries, they will arrive to you as separate deliveries.

Delivery charges

winery2u.com has negotiated with wineries on your behalf for a flat $10 delivery fee per case to most areas in Australia. That covers most regional cities and all capital cities.

If you live in a remote area, please contact winery2u.com on info@winery2u.com to confirm your delivery charges. If you have already placed your order, we will contact you to inform you of the delivery charges. We can guarantee however that our rates will be lower than those quoted by Australia Post.

For orders outside Australia, we reserve the right to confirm delivery costs before processing the order. Those costs must be bound by the customer. If you are ordering from outside Australia, please contact info@winery2u.com so our team can help you directly, to eliminate any confusion.

Mixed cases

Most wineries are happy to package mixed cases of wine. If you would like a mixed case, please contact us on info@winery2u.com and we will arrange it for you. Our friendly team is here to help you as much as possible. Please note, however, that mixed cases can only be done from individual wineries, not from multiple wineries.

Our partners

One of the main benefits with buying via winery2u.com is that you have a representative who is experienced in ordering wine. You also can rest assured that we know each and every owner of the wineries with whom we partner.

The size of our partners varies considerably. Some are large operations with highly organised and complex delivery systems. Others are small boutique operations, often run by a retiree couple, who will process your order manually, often write your name and address by hand – and in some situations, deliver your wine 30km or more to the post office so it can reach you safely. If on the off chance they make a mistake with your order, please be patient. We will help as best we can to work out a feasible and fair solution.

winery2u.com is the first point of contact for all complaints. We always strive for a fair and rapid solution to any problem you might have. Quality, delivery and the processing of orders is, however, ultimately the responsibility of the winery.

Privacy

We collect and use your personal information in accordance with our privacy policy which can be viewed here. When making a purchase, you are required to provide a contact telephone number. By providing this number you authorise us to contact you if we deem it will help streamline the delivery of your purchase. We will not provide you number to any third party, nor will be contact you for any marketing or sales activities unrelated to your purchase. winery2u.com values your business and will not abuse that relationship.

Protocol

winery2u.com is one of the few wine websites which allows you to comment about wines. We choose to moderate all comments which are published. While wineries are aware that their products might be criticised by you, all criticism must be justified and the opportunity for a right of reply will always be given to the winemaker. We monitor IP addresses and sources of emails, which means any untoward use of the comments system will not be tolerated. Any abusive comments will be erased, and the user blocked from any future use of the site. There will be no warnings.

Winery2u.com is a community. We are intent on making it a friendly environment for all users. Any abusive emails, notes, phone messages, or comments of any malicious nature will be deleted without response, regardless of their purpose.

If, for any reason, content which is published on winery2u.com contains incorrect or misleading information, we will correct it or delete it as soon as practically possible. If you see such information, please let us know. It is our policy to get it right. It is also our policy to be fair in our news reporting.

Content and intellectual property

The content, including words and photographs, layout, design and site concept are subject to copyright. Some content is sourced from third parties and is done so on the understanding that winery2u.com will respect the copyright of those organisations. All registered marks and trademarks are the property of their respective owners. If you wish to reproduce anything sourced from winery2u.com, please be sure to obtain prior written permission.

As a user of the site, you are granted a temporary, non-exclusive license to download, print or reproduce in unaltered form a single copy of content for personal, non-commercial use. You may also share content via our Facebook, or other authorised means.

It is our policy to delete or correct any information which is found to be incorrect. We will do that as soon as practically possible after being notified of the error.

We also cannot be held responsible for comments, opinions or judgements made by third parties quoted on the site.
